DEFINITIONS
“ Customer ” means any natural or legal person who places an Order on this Website;
“ Order ” means any order placed by the User registered on this Site, with a view to benefiting from the Company’s Services;
" General Conditions of Sale and Use " or " GCS/CGU " means these general conditions of sale and use online;
" Consumer " means the buyer, a natural person who is not acting for professional needs and/or outside his professional activity.
“ Services ” means all services offered to Users by the Company through this Site;
“ Site ” means this Site, i.e. www.ginesatelier.com;
“ Ginès Atelier ” means the company Ginès Atelier;
“ User ” means any person who uses the Site.
These General Conditions of Sale are concluded between, on the one hand, the company Ginès Atelier (Siret number 94091948300013 ), on the other hand the natural or legal persons wishing to use the company Ginès Atelier, hereinafter referred to as "the customer".
Article 1: ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
These General Terms and Conditions of Sale and Guarantees are intended to define the terms and conditions under which the company Ginès Atelier offers the marketing of its creative workshops to its customers, as well as the sale of products. Any visitor may freely consult the General Terms and Conditions of Sale at any time on the website www.ginesatelier.com. These General Terms and Conditions of Sale may be subject to modification; the applicable conditions are those in force on the website www.ginesatelier.com on the date the order is placed.
Consequently, any order from the buyer implies his unreserved acceptance and full adherence to these General Conditions of Sale and guarantees which prevail over any other document, except for special conditions expressly agreed to in writing by the seller.
The buyer acknowledges having read the General Conditions of Sale and guarantees prior to placing his order.
Article 2: REGISTRATION FOR COURSES
Ginès Atelier offers tickets for sale to participate in its creative workshops. These workshops take place in locations with which Ginès Atelier has previously agreed and will notify the Consumer of the location where the workshop will take place upon registration, but reserves the right to change the location where the workshop will take place.
Reservations for Ginès Atelier workshops are made online via the website www.ginesatelier.com.
Workshop reservations are subject to availability, as long as the course is open for reservations. Ginès Atelier cannot be held responsible for any unavailability on the chosen date, including unavailability caused by a technical problem.
After completing the registration form and making the online payment, the client will receive an email confirming their workshop reservation at the email address they provided. This email includes the name of the person for whom the reservation was made, the number of places reserved, the type of workshop, and the date and time of the workshop for which the reservation was made.
Only the Consumer is authorized to attend the workshops. For the smooth running of the workshops, any accompanying person will be refused entry to the premises.
Article 3: PRICES
Ginès Atelier offers, through its website and partners, the sale of creative workshops and accessories. Customers can find out the prices of each product by visiting www.ginesatelier.com.
The prices of workshops and boxes are displayed on the Site, are indicated in Euros and are those in effect on the day of the order. Prices are expressed in euros including VAT.
Article 4: PAYMENT
The Customer can make his payment by bank card. The Customer guarantees to the Seller that he is the holder of the bank card used for payment of the Order and that he has sufficient funds to cover the full payment of his Order.
Payment will be debited at the time the Order is validated by the Customer.
If it is not possible to debit the amounts due in payment of the Order, for whatever reason, the Order will be cancelled.
Payments by credit card are made using secure transactions provided by an online payment platform provider acting in accordance with industry standards.
The Seller does not have access to any data relating to the Customer's payment methods except for the last digits of their bank card. Payment is made directly to the bank or payment service provider receiving the Customer's payment.
Article 5 – POSTPONEMENT AND CANCELLATION OF WORKSHOPS BY GINES ATELIER
When the minimum number of participants is not reached for one of the workshops, Ginès Atelier reserves the right to cancel or postpone the workshop. In this case, you will be offered a rescheduled workshop as soon as possible.
Article 6 – GIFT CARD
Gift cards are redeemable for a workshop offered by Ginès Atelier. They are personal and valid for a non-renewable period of 1 year from the date of issue. Reservations can be made either at the time the gift certificate is issued or later by the recipient of the gift certificate themselves.
Reservation and participation must be made during the validity period of the gift voucher.
Article 7 – AVAILABILITY OF PLACES
Our workshop places are only valid while spaces are available. If, despite our best efforts, a workshop presented on the site proves unavailable after you have placed your order, we will inform you by email as soon as possible. In accordance with the provisions of Article L121.20.3 of the French Consumer Code, we may in this case provide a product of equivalent quality and price. If we fail to exercise this option, you will be reimbursed as soon as possible.
Article 8 – WORKSHOP ACCOMPANISTS
Our workshops are held in small groups. To ensure the workshops run smoothly and to respect the work of the facilitators, you cannot bring an adult or a child. Pets are not allowed.
Article 9 – RIGHT OF WITHDRAWAL, REFUND, EXCHANGE AND POSTPONEMENT
Gift cards
Your right of withdrawal for the purchase of a “gift card” is valid for up to 14 days following the date of purchase.
You must contact Ginès Atelier by email (ginesatelierparisien@gmail.com) no later than 14 days following the date of your purchase. You are not required to provide us with a reason for your cancellation, but you must provide your name, customer number, and order details. Any claim made outside of this timeframe will not be accepted.
We will refund your bank account no later than 30 (thirty) days from the date of validation of your right of withdrawal.
Workshops
Workshop reservations, once paid, are non-refundable.
A reservation can only be postponed - up to a maximum of once per client - at the client's request if this request is made by email at least one week (seven days) before the date of the workshop. The client may make a new reservation within a maximum of 3 months from the date of cancellation of the course.
If the client does not show up on the day of the workshop or shows up late and disrupts the ongoing workshop, the place is considered lost.
In the event of the client's absence due to illness or force majeure, the client must provide a medical certificate or supporting documentation proving the force majeure. The supporting documentation provided must be in the name of the client and is only valid for the person concerned (if you have two reservations, only the reservation of the person concerned can be postponed upon presentation of the supporting documentation).
Ginès Atelier reserves the right to accept or refuse to postpone its workshop.
Article 10 - DELIVERY
The Products ordered will be delivered to the address indicated by the Customer when creating their personal Account on the Site, according to the delivery method chosen by them when placing their Order.
Delivery times are indicated on the Site and depend on the delivery method chosen by the Customer (Colissimo, Chronopost, Lettre Suivie, etc.)
In any event, Ginès Atelier undertakes to deliver the Products within a maximum of 90 (ninety) days from the Order validation email sent to the Customer by Ginès Atelier. Delivery times exclude Sundays and public holidays.
However, the Customer acknowledges that Ginès Atelier uses external service providers (carriers, postal services, etc.) responsible for the delivery of packages containing the Products. Therefore, the delivery times indicated on the Site may be impacted by the service providers without Ginès Atelier being responsible for these delivery delays and the consequences that may result from them.
Furthermore, it is expressly agreed that in the event that Ginès Atelier is unable to deliver a Product under the conditions provided for herein due to a failure by one of its Suppliers (delay in delivery, non-compliance of the Order in particular), the Customer will be informed by Ginès Atelier as soon as possible and by any means. In this event, the Customer will be reimbursed within 14 (fourteen) days. Ginès Atelier's liability is therefore limited to the amount of the Product ordered by the Customer.
Article 11: CONFIDENTIALITY AND COOKIES
In accordance with Law No. 78-17 of January 6, 1978, relating to information technology, files, and civil liberties, each customer has the right to access and rectify their personal information by sending an email to ginesatelierparisien@gmail.com. The information provided by the customer when making a reservation and when using the website www.ginesatelier.com is subject to computer processing intended to ensure better monitoring of customer relations. Ginès Atelier ensures that this data is kept confidential. Information is not shared with potential business partners or third parties without the express prior authorization of the customer.
The website www.ginesatelier.com requires the use of cookies. These cookies are only used for the proper functioning of the customer account system, virtual shopping cart, and ordering system.
Article 12: INTELLECTUAL PROPERTY
The Ginès Atelier brand is a trademark registered with the INPI (French Institute for Industrial Property). The Ginès Atelier brand and logo are protected works under intellectual property law, the exclusive property of which belongs to the Ginès Atelier company. All elements of this site, including texts, graphics, logos, photos or videos, as well as the domain names www.ginesatelier.com / www.ginesatelier.fr etc. are the exclusive property of Ginès Atelier, excluding elements originating from its partners, and are protected as such by legislation relating to intellectual property rights and databases.
Any use or reproduction, in whole or in part, on any medium and for any purpose, without the prior and express consent of Ginès Atelier, is prohibited and may be subject to prosecution for infringement.
